Brisbane General Protections Lawyers

If your employer has dismissed you, demoted you, cut your hours or treated you badly because you took sick leave, made a complaint, asked about your pay or stood up for a workplace right, you may have a general protections claim under the Fair Work Act. General protections claims are different from unfair dismissal claims. There is no minimum period of employment, no high income threshold and no small business exemption. Casuals, probationary employees and senior executives are all covered. Important!

a general protections dismissal application must be lodged within 21 days from the date of dismissal

The 21-day limit is strict. The Fair Work Commission can only accept a late application in exceptional circumstances, and it rarely does. If you think you were dismissed for a prohibited reason, get advice straight away.

Dismissal includes:

  • Being given notice of termination by your employer.
  • Being told your position is redundant, where the real reason was something else.
  • Feeling you had no choice but to resign because of your employer’s conduct.

If you are still employed, there is no 21-day limit. A claim about a demotion, a cut to your hours, a warning or other adverse action while you remain employed can generally be brought within six years. But evidence goes stale and witnesses move on, so earlier is always better.
